End User License Agreement
Effective date: January 1, 2027
This agreement is between you and 17-BIT Co LTD, a company organized under the laws of Japan with its office at 37-4 Hounenin Nishimachi Shishigatani Sakyo-ku, Kyoto, Japan 606-8427 ("we," "us"). It covers AWAYSIS (the "Game") and its updates and downloadable content. By installing or playing the Game you agree to it and to our Privacy Policy at 17-bit.com/faq/privacy-policy-terms-service-awaysis. If you do not agree, do not install or play, and ask the store for a refund under its policy.
1. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to play the Game on devices you own or control, for your own non-commercial use. The Game is licensed, not sold. We and our licensors keep all rights not expressly granted.
2. Restrictions
Except where the law gives you a right that cannot be waived, you may not copy, modify, rent, sell, or distribute the Game; reverse engineer or extract code or assets from it; use cheats, exploits, or unauthorized software; bypass protection or licensing systems; or use it commercially. You may make non-commercial videos, streams, and screenshots of the Game, as long as you do not present them as official.
3. Online Play
Online play is peer to peer and uses your platform's networking services and Epic Online Services (EOS). We do not run servers for the Game, do not guarantee online play will be available or uninterrupted, and are not responsible for other players' conduct or for the platform's services. Treat other players respectfully and report abuse using your platform's tools. When you play online, other players may see your network address and platform display name, as our Privacy Policy explains.
4. Platform Terms
Your platform or store's terms, and Epic's terms for EOS where they apply, also apply. The platform operator is not a party to this agreement, is not responsible for the Game or its support, and may enforce this agreement as a third-party beneficiary where its terms require.
5. Ownership
The Game, including its code, characters, story, art, music, names, and logos, belongs to us or our licensors and is protected by law in Japan and abroad. Nothing in this agreement transfers ownership to you.
6. Termination
This agreement lasts until terminated. You may stop at any time by uninstalling. We may end your license if you materially breach this agreement, with notice where practical. On termination you must stop using the Game.
7. Disclaimer and Limitation of Liability
To the maximum extent the law allows, the Game is provided "as is" and without warranties of any kind, and we are not liable for indirect or consequential damages or lost profits, data, or goodwill. Our total liability is limited to the amount you paid for the Game, or [JPY 5,000 / USD 50] if greater. Nothing here limits liability that cannot be limited by law, including for death or personal injury, fraud, or damage caused by our intent or gross negligence, or the mandatory consumer rights of the place where you live.
8. Minors
The Game is family-friendly, and children may play. If you are under 18, you may play with your parent or guardian's permission, and they are responsible for your use, including any purchases made on your platform.
9. Governing Law
This agreement is governed by the laws of Japan. The Kyoto District Court has non-exclusive jurisdiction in the first instance, to the extent the law allows. If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live.
10. General and Contact
We may update this agreement by giving notice in the Game or on our website before changes take effect. This agreement, the Privacy Policy, and the platform's terms are the whole agreement. If a part is unenforceable, the rest stays in effect. If translations differ, the [English / Japanese] version controls where the law allows.
